    For the attention of: CORPORACION ACUATICA SA DE CV/GRUPO NÁUTICO CASTILLO Y CORPORACIÓN ACUÁTICA SA DE CV y/o Hoteles H10 Ocean Maya Royale, H10 Ocean Coral & Turquesa H10 Ocean Riviera Paradise.

    I declare under oath that I am aware that the aquatic activity to be developed can be a strenuous. Activity that require basic swimming skills, and I is not recommended for pregnant woman o elder persons over 70 years old with cardiac affections.

    I've been provided, reviewed and use all necessary safety gear to carry out the contracted activity and the service provider had carried out all needed and sufficient actions to safeguard may physical and mental safety and physical integrity. I agree that use of a life jacket is mandatory during the aquatic activities.

    If I were to ask and take any medication from the staff members of the company, I will be entirely my responsibility .

    Likewise I declare under protest of true that I will not carry out the activity under influence of alcohol or any other drug, and that I'll not consume those during the Development of the aquatic activity.

    I am also aware that I do not have accident insurance that covers the activity I am contracting.

    I HEREBY DECLARE THAT I DO HAVE ACCIDENT INSURANCE CONTRACTED BY MYSELF - Insurance information: ________________________________________________________________

    I received the equipment in good conditions and I agree to return it in the same good conditions. In the event of damages, breakage or total loss.

    I leave a deposit of $50.00 US dollars (IN MANDATORY CASH), which refundable.*

    *If it is necessary that they come to rescue me and bring the catamaran back to the hotel beach, it will not be refundable. This will also not be refunded if I damage the equipment and it will be taken as part of the payment.

    Applying $50.00 US dollars per square inch, plus parts that are damaged, plus: loss of revenue caused by inactivity of the equipment.

    RISK-WAIVER & REALESE OF LIABILITY

    I HEREBY VOLUNTARILY RELEASE, FOREVER DISCHARGE, AND AGREE TO INDEMNIFY AN HOLD GRUPO NÁUTICO CASTILLO Y CORPORACIÓN ACUÁTICA SA DE CV and Hotels H10 Ocean Maya Royale, H10 Ocean Coral & Turquesa H10 Ocean Riviera Paradise, Tour operators'__________________________.

    HARMLESS FROM any and all claims, demands and causes of action either in law, admiralty or equity, by reason of any matter, cause or thing whatsoever, known or unknown, which are in any way associated with my participation on this activity, the use of GRUPO NÁUTICO CASTILLO Y CORPORACIÓN ACUÁTICA SA DE CV and Hotels H10 Ocean Maya Royale, H10 Ocean Coral & Turquesa H10 Ocean Riviera Paradise, Tour operators'______________________________, equipmentand facilities, including any such claims which ALLEGE NEGLIGENCE OUTSIDE OF THE INHERENT RISK OF THE ACTIVITY CONTRACTOR BOOKED AND ANY INJURY, DEATH OR PROPERTY DAMAGE WHATSOEVER, RELATED TO AND ANY WAY CONNECTED WITH MY INVOLVEMENT TO THE ACTIVITY.

    In other words, by signing below this document I am giving up the right to sue GRUPO NÁUTICO CASTILLO Y CORPORACIÓN ACUÁTICA SA de CV and Hotels H10 Ocean Maya Royale, H10 Ocean Coral & Turquesa H10 Ocean Riviera Paradise, Tour operators'__________________________________, for any injury, death or loss of any kind caused by accident while I am participating in the activity, including transportation and transit to and from the activity.

    For everything related to interpretation, fulfillment and implementation of this document where is stated the will of the company and the person contracting the activity, the Spanish version will prevail and the parties submit to the applicable law and jurisdiction of the competent courts of Quintana Roo Mexico, expressly renouncing to any, forum, court, privilege or action that they might be entitled to, in regard to their current or future address or nationality.

    I acknowledge and agree that in the moment I'm signing this document its content becomes property of GRUPO NÁUTICO CASTILLO Y CORPORACIÓN ACUÁTICA SA DE CV and that I can ask for a copy in ths very moment, otherwise I agree that in case thatin the future I require a copy I shall ask it through the correspondent legal means.
